Aim

Choose A Resource aims to ensure all of our valued customers and members have full access to and receive transparent communication regarding the terms of agreement, policies and procedures and services provided through our online educational resource platform.

 

Rationale

The terms of agreement, policies and procedures have been developed to provide a clear understanding of and a consistent approach to the use of Choose A Resource’s website.

Through common understanding and execution of the scope and requirements of all terms of agreement and policies, Choose A Resource can provide a high quality online service and respond to customer and member feedback and queries as they arise. 

 

Purpose

The purpose of these terms of agreement, policies and procedures is:

·         P1.1 - To provide a high quality service and marketplace for educational resources that allows customers and members the opportunity to explore our Choose A Resource website.

·         P1.2 - To increase customer confidence and satisfaction when exploring our Choose A Resource website.

·         P1.3 - To provide transparent communication to all customers about the terms, conditions, policies and procedures that supports the running of Choose A Resource.

 

Principles

The key principle is to ensure that all valued subscription members and customers of Choose A Resource are provided with the opportunity to use our website in a safe and secure manner and whilst their consumer rights are protected.

Choose A Resource will make reasonable adjustments to the website and to the terms, conditions, policies, procedures, fees or features to ensure our members and customers continue to experience a high quality service. Reasonable adjustments will only occur when deemed necessary, through a consultative review process. The Choose A Resource team will take all practicable steps to ensure reasonable adjustments are provided and communicated with transparency to all of our valued subscription members and customers via updates on our Choose A Resource website and through the Members Site within the website.

 

Responsibilities

a)      As Choose A Resource, we will:

a.      Ensure our Terms, Agreements, Policies and Procedures are implemented transparently and with efficacy.

b.      Review our Terms, Agreements, Policies and Procedures regularly to ensure they continue to meet the needs of non-Member customers and annual subscription members.

c.      Communicate any and all changes to our Terms, Agreements, Policies and Procedures at least 4 weeks prior to changes being made.

b)      As non-subscription customers, we will:

a.      Read all Choose A Resource Terms, Agreements, Policies and Procedures prior to purchasing a resource or bundle from the Choose A Resource Shop.

b.      Read the descriptions of each resource or bundle for sale as a product in the Choose A Resource Shop.

c.      Preview the bundles and resources for sale as products in the Choose A Resource Shop.

d.      Provide accurate and truthful information when registering an account with Choose A Resource.

e.      Be responsible for paying the full amount due for a transaction (bundle or resource) including all applicable taxes when purchasing products from Choose A Resource’s online shop.

c)      As annual subscription members, we will:

a.      Read all Choose A Resource Terms, Agreements, Policies and Procedures prior to purchasing a membership subscription.

b.      Read the descriptions and pricing of each type of membership prior to subscribing.

c.      Read the Subscription Policy and Refund Policy related to membership subscriptions thoroughly prior to subscribing.

d.      Provide accurate and truthful information when registering an account with Choose A Resource.

e.      Be responsible for paying the full amount due for the membership fee, including all applicable taxes when purchasing an annual membership with Choose A Resource.

Terms of Service

1. Introduction

Welcome to Choose A Resource! These Terms of Service govern your access to and use of our website and services. By accessing or using our website, you agree to be bound by these Terms.

2. Account Registration

  • Eligibility: Choose A Resource downloadable resources and bundles are available to all those seeking educational resources to inspire curious minds, whether they be in an on-site campus or home-school setting. They are available to all those wishing to improve student learning outcomes, empower classrooms and elevate schools.

    • To register an account, you must be 18 years of age or older. By registering an account with Choose A Resource or using our online store and services, you acknowledge that and represent yourself as 18 years of age or older.

    • To register for small group membership or whole school membership, the person registering (including their email address) must have authority to make this agreement.

    • All who register must use accurate and true information. You must not falsify information, misrepresent or violate someone else’s rights.

  • Account Creation: To access certain features, you must create an account and provide accurate information. You must not use inappropriate, insensitive or offensive usernames. If account creation terms are violated, your account will be closed, and you can no longer register with Choose A Resource.

3. Membership and Download Options

  • Non-Member Downloads: Non-members can purchase and download resources and bundles on a per-resource or per-bundle basis. All resources and bundles will be charged at the prices identified on the bundles and resources.

  • Membership Subscription: There are three tiers of membership: Individual, Small Group, and Whole School. Memberships last for 12 months from the time of payment of the membership fee and are automatically renewed annually. Members can pay annual fees of:

    • Individual memberships AUD $105 for unlimited access to all resources for free.

    • Small group (up to 10 members) memberships AUD $420 for unlimited access to all resources for free.

    • Whole school memberships

      • Annual pricing is dependent on the number of staff in your school and will therefore vary from school to school.

      • AUD $3,500 for staff 40 to 99

      •  AUD $6,500 for staff 100 to 200

      • Please contact us for other pricing.

    • All subscription members will have access to the following Choose A Resource resources and services:

      • Enjoy free and unlimited access to all 600 plus ‘CHOOSE A RESOURCE’ resources for the entirety of the membership.

      • Enjoy free and unlimited access to the new resources added daily

      • Enjoy access to the ‘global community resource development’ where members can request resources to be created by our creative team, which will be provided for free for the entirety of the members’ annual membership!

      • Coming soon and to be free for all members: Pre-recorded professional learning videos and slides on an array of pedagogical and school-related topics.

      • Membership subscriptions can be renewed annually.

4. Payments, Fees, Taxes and Billing for non-members and members

  • Payment Methods: We accept PayPal as our payment method.

  • Membership Renewal: Memberships automatically renew annually. You will be notified prior to renewal.

  • You are responsible for paying the full amount due for a transaction (bundle or resource) or fee (membership), including all applicable taxes when you purchase on Choose A Resources website.

  • All payments are made in Australian dollars (AUD).

5. Refund Policy

  • Non-Member Purchases: All customers must ensure they have previewed the images of the available resources prior to download. All purchases are final, and we do not offer refunds for non-member downloads.

  • Membership Fees: Membership fees are non-refundable, except as required by law.

6. Resource Use and Restrictions

  • Permitted Use: Resources are for personal and educational use only.

  • Prohibited Use: You may not redistribute, sell, or exploit the resources for commercial purposes.

7. Changes to Terms

We may update these Terms from time to time. We may, at our discretion, make changes to terms, fees, memberships, features and privileges offered through our Choose A Resource website. Any changes will be communicated to you at least four weeks before they take effect to all affected users via email address associated with the account and by a notice placed on our Choose A Resource website from four weeks before the change(s) occur.

Subscription Policy

a)      Introduction

This Subscription Policy outlines the terms and conditions related to the membership subscriptions offered on our website. By subscribing, you agree to comply with and be bound by this policy.

b)      Subscription Plans

We offer the following subscription plans:

  • There are three tiers of membership: Individual, Small Group, and Whole School. Members can pay annual fees of:

    • Individual memberships AUD $105 for unlimited access to all resources for free. Membership is assigned to only one individual (assignee, e.g., a teacher, a home-schooling parent) and must not be transferred to another person.

    • Small group (up to 10 members) memberships AUD $420 for unlimited access to all resources for free. Membership is assigned to the member (assignee) who provides their email address for registration. This member must have the authority to bind their organisation (e.g., school sub group like a small cohort team, Year 4, or a subject team, History) to this policy agreement.

    • Whole school memberships

      • Annual pricing is dependent on the number of staff in your school and will therefore vary from school to school.

      • AUD $3,500 for staff 40 to 99

      •  AUD $6,500 for staff 100 to 200

      • Please contact us for other pricing.

      • Membership is assigned to the member (assignee) who provides their email address for registration. This member must have the authority to bind their organisation (e.g., school) to this policy agreement.

    • All subscription members will have access to the following Choose A Resource resources and services:

      • Enjoy free and unlimited access to all 600 plus ‘CHOOSE A RESOURCE’ resources for the entirety of the membership.

      • Enjoy free and unlimited access to the new resources added daily

      • Enjoy access to the ‘global community resource development’ where members can request resources to be created by our creative team, which will be provided for free for the entirety of the members’ annual membership!

      • Coming soon and to be free for all members: Pre-recorded professional learning videos and slides on an array of pedagogical and school-related topics.

c)      Subscription Payment and Billing

·         Payment Methods: We accept PayPal as our payment method.

·         Billing Cycle: Subscriptions are billed annually on a recurring basis.

·         Authorisation: By subscribing, you authorise us to charge the applicable subscription fees to your chosen payment method.

·         You are responsible for paying the full amount due for a fee (membership), including all applicable taxes when you purchase on Choose A Resources website.

·         All payments are made in Australian dollars (AUD).

d)       Subscription Renewal

·         Automatic Renewal: All subscriptions automatically renew at the end of the billing cycle unless canceled prior to renewal.

·         Notification: We will send you a reminder email 2 weeks before the renewal date.

e)      Cancellation Policy

·         How to Cancel: You can cancel your subscription at any time through your account settings or by contacting our support team.

·         Refunds: Cancellations are effective immediately. We do not offer refunds for partial billing periods.

f)        Changes to Subscription Plans

We reserve the right to modify our subscription plans or fees at any time. Any changes will be communicated to you at least 4 weeks in advance.

Intellectual Property Rights and Resource Publishing Rights Policy

1. Introduction

This Intellectual Property (IP) Rights and Resource Publishing Rights Policy outlines the terms and conditions related to ownership of the content, resources and publishing rights for Choose A Resource. By accessing or using our website, you agree to be bound by the terms in this policy.

 

a) Intellectual Property (IP) Rights

1. Copyright: All site assets and content published on this website, including but not limited to PowerPoint presentations, worksheets, templates, and Excel spreadsheets, is the intellectual property of Choose A Resource. Unauthorised use, reproduction, or distribution of this material for commercial use and gain is strictly prohibited.

Squarespace: Choose A Resource is made and powered by ‘Squarespace’. You may not sell, sublicense, redistribute, rent, reverse engineer, republish, re-translate, disassemble, copy, modify, perform, use in your own website or business, incorporate into marketing and advertising materials any Squarespace Site Assets.

2. Trademarks: All trademarks, service marks, and trade names of Choose A Resource used on the site are trademarks or registered trademarks of Choose A Resource. Any unauthorised use of these marks is strictly prohibited.

3. Patents: Choose A Resource may offer unique software or tools that are protected by patent laws. Unauthorised use or reproduction of these tools is prohibited.

4. Trade Secrets: The proprietary methods and processes used to create the educational content on this website are protected as trade secrets. Disclosure of these methods and processes is strictly prohibited.

 

b) Resource Publishing Rights

1. Purchasing Resources Licensing Agreement:  When purchasing a Choose A Resource bundle, resource, or membership, you are purchasing a license to use said bundle, resource or membership in accordance with the terms of this Intellectual Property (IP) Rights and Resource Publishing Rights Policy. All downloadable bundles, resources and memberships can only be used in accordance with a license:

o   Non-Membership and Individual Membership License

o   Small Group Membership License

o   Whole School Membership License

When you use any resource, bundle, or membership, you agree to comply with and be subject to the terms and conditions of this Intellectual Property (IP) Rights and Resource Publishing Rights Policy and other terms and conditions in the Choose A Resource Terms, Conditions, Policies and Procedures.

a.      Non-Membership and Individual Membership License

A Non-Membership and Individual Membership License is a license that is purchased and assigned to only one person (assignee) and must not, under any conditions, be transferred shared, sold, or sublicensed to another user.

All customers who purchase a downloadable resource or bundle from Choose A Resource, but do not choose to register an annual membership automatically agree to comply with the terms of this Intellectual Property (IP) Rights and Resource Publishing Rights Policy and other terms, including this Non-Membership and Individual Membership License.

 All Individual Membership subscribers automatically agree to comply with the terms of this Intellectual Property (IP) Rights and Resource Publishing Rights Policy and other terms, including this Non-Membership and Individual Membership License, when choosing to purchase an annual membership subscription.

 Purchases:

Once you purchase a resource, bundle or individual membership and therefore a Non-Membership and Individual Membership License, Choose A Resource permits you to:

·         Use the resource, bundle or features of the Individual Membership for personal, educational or instructional purposes only (“Personal Use”).

·         Print and/ or photocopy the resource or bundle and distribute them to students, teacher supports (aides) and classroom relief teachers as necessary. Resources or bundles may also be printed and/ or photocopied for observational purposes, be it as classroom displays or as support documents for students’ parents/ carers, whanau/ families, school leadership team, school administration, or classroom observers.

·         Electronically present PowerPoints and other resources or bundles to permitted recipients: students, and as needed to parents/ carers, whanau/ families, school leadership team, school administration, or classroom observers.

·         Share the resources to ‘permitted recipients’ only. Resources may not be uploaded to shared drives, websites or other sites where anyone apart from ‘permitted recipients’ can access them, e.g., If anyone else has access to your students’/ class’ Google Classroom, Google Sites, or Microsoft Teams, you may not upload the resources, bundles, or features of the Individual Membership to them.

Unless you have been given express written permission from Choose A Resource, you may not use the resource, bundle, or features of the Individual Membership in any way, shape or form, part or whole, for commercial purposes.

 

b.      Small Group Membership License

A Small Group Membership License is a license that is purchased and assigned to a small group (of up to 10) people (assignees) and must not, under any conditions, be transferred shared, sold, or sublicensed to another user. This license suits small teams of teachers of a subject, e.g., History, or a cohort, e.g., Year 4 team.

All Small Group Members:  When the nominated person with authority to bind the group (e.g., Year 4 team of up to 10 people from one school) subscribes to the Small Group Membership on behalf of the team, all members of the small group automatically agrees to comply with the terms of this Intellectual Property (IP) Rights and Resource Publishing Rights Policy and other terms, including this Small Group Membership License.

Purchases as a Small Group Membership License holder:

Once your small group purchases a Small Group Membership and therefore a Small Group Membership License, Choose A Resource permits you to:

·         Use the resources, bundles or features of the Small Group Membership for personal, educational or instructional purposes (“Personal Use”).

·         Share the resources, bundles or features of the Small Group Membership among the members of your group only.

·         Print and/ or photocopy the resource(s) or bundle(s) and distribute them to students, teacher supports (aides) and classroom relief teachers as necessary. Resources or bundles may also be printed and/ or photocopied for observational purposes, be it as classroom displays or as support documents for students’ parents/ carers, whanau/ families, school leadership team, school administration, or classroom observers.

·         Electronically present PowerPoints and other resources or bundles to permitted recipients: students, and as needed to parents/ carers, whanau/ families, school leadership team, school administration, or classroom observers.

·         Share the resources to ‘permitted recipients’ only, e.g., the Year 4 student’s in your school OR to the History students in your subject area. Resources may not be uploaded to shared drives, websites or other sites where anyone apart from ‘permitted recipients’ can access them, e.g., If anyone else has access to your students’/ class’ Google Classroom, Google Sites, or Microsoft Teams, you may not upload the resources, bundles, or features of the Small Group Membership to them. All editable bundles downloaded using the Small Group Membership License can be used, edited and distributed within your group and to your ‘permitted recipients’ outlined above, for educational or personal use only, with proper attribution to Choose A Resource.

Unless you have been given express written permission from Choose A Resource, your small group (assignees) may not use the resource(s), bundle(s), or features of the Small Group Membership in any way, shape or form, part or whole, for commercial purposes.  

 

c.      Whole School Membership License

      • A Whole School  Membership License is a license that is purchased and assigned to a whole school or organisation and must not, under any conditions, be transferred shared, sold, or sublicensed to another user outside of the school or organisation. Annual pricing for Whole School Memberships is dependent on the number of staff in your school and will therefore vary from school to school: AUD $3,500 for staff 40 to 99; AUD $6,500 for staff 100 to 200; Please contact us for other pricing. Membership is assigned to the member (assignee) who provides their email address for registration. This member must have the authority to bind their organisation (e.g., school) to this Membership and therefore Choose A Resource Terms, Conditions, Policies and Procedures.

All Whole School Members:  When the nominated person with authority to bind the group (e.g., school) subscribes to the Whole School Membership on behalf of the school or organisation, all of its members automatically agrees to comply with the terms of this Intellectual Property (IP) Rights and Resource Publishing Rights Policy and other terms, including this Whole School Membership License.

Purchases as a Whole School Membership License holder:

Once your school or organisation purchases a Whole School Membership and therefore a Whole School Membership License, Choose A Resource permits you to:

·         Use the resources, bundles or features of the Whole School Membership for personal, educational and instructional purposes (“Personal Use”).

·         Share the resources, bundles or features of the Whole School Membership among the members of your school or organisation only.

·         Print and/ or photocopy the resource(s) or bundle(s) and distribute them to students and classroom relief teachers as necessary. Resources or bundles may also be printed and/ or photocopied for observational purposes, be it as classroom, cohort, subject area or whole school displays or as support documents for students’ parents/ carers, whanau/ families, school leadership team, school administration, classroom observers or temporarily visiting external educational review officers and observers.

·         Electronically present PowerPoints and other resources or bundles to permitted recipients: students of your school or organisation, and as needed to parents/ carers, whanau/ families, school leadership team, school administration, classroom observers or temporarily visiting external educational review officers and observers.

·         Share the resources to ‘permitted recipients’, e.g., registered students at your school. Resources may be uploaded to shared drives, websites or other sites where ‘permitted recipients’ can access them, e.g., your students’/ class’ Google Classroom, Google Sites, or Microsoft Teams.

·         Public facing resources / documents initially created by Choose A Resource and kept the same or modified can be shared on your school’s or organisation’s website and other sites that your school or organisation has authority to govern or control. For this purpose, proper attribution to Choose A Resource must be addressed.

·         All editable bundles downloaded using the Whole School Membership License can be used, edited and distributed within your school organisation for educational or personal use only, with proper attribution to Choose A Resource.

Unless you have been given express written permission from Choose A Resource, your school or organisation may not use the resource(s), bundle(s), or features of the Whole School Membership in any way, shape or form, part or whole, for commercial purposes.

 

2. Content Creator Licensing Agreements: Choose A Resource may enter into licensing agreements with content creators. By using this website, you agree to adhere to the terms set forth in these agreements.

3. Creative Commons Licenses Some content on this website may be licensed under Creative Commons. You are free to use, share, and modify this content under the conditions specified by the respective Creative Commons license.

4. Permissions For any third-party content used on this website, Choose A Resource has obtained the necessary permissions from the copyright owners. Unauthorised use of third-party content is prohibited.
